La Segunda Ley del Yo Digital
Decíamos ayer cuando queríamos postular las tres leyes del Yo Digital a semejanza de las tres ley de la robóticas de Isaac Asimov. (Ver post anterior)
Y así formulábamos la primera ley:
1ª La inviolabilidad del Yo Digital.
Como antesala a la segunda ley y entre los comentarios del post anterior surgía la siguiente pregunta:
¿Pueden ser mis yo digitales adúlteros sin serlo mi yo analógico?
Y entre discusiones acerca de la anterior pregunta la mejor respuesta fue, quizá otra pregunta:
¿Con quién haces el amor, con quién te acuestas, o con quien piensas mientras haces el amor con quien te acuestas?
Y así formulamos la 2ª ley del Yo Digital
2ª El Yo Analógico es responsable de su Yo Digital ante otros Yoes y debe responder ante ellos sólo siempre y cuando no interfieran estos con la primera ley. La inviolabilidad del Yo Digital.
Evidentemente no somos dioses y por ello somos responsables de nuestras creaciones, las digitales también. Los dioses siempre podían delegar las culpas en su creaciones humanas, que para ello les dieron el libre albeldrío y enviar diluvios (Noe) o ángeles exterminadores (Sodoma y Gomorra) y así hacer pagar por sus actos a sus ovejas descarriadas, eximiendose asímismo de culpa.
Pero si existe este blog es porque pensamos que hemos evolucionado a una existencia digital y que mi yo esta formado tanto por mi ser analógico como por mi ser digital. (Curiosamente este último tiene más posibilidades de perdurar que el biológico). Y debemos preservar sus derechos a imagen y semejanza de nuestros Yo Analógicos del Siglo XX.
¿Pueden ser mis yo digitales adúlteros sin serlo mi yo analógico?
Si una parte de mi Yo Digital liga con otro Ente Digital es análogo a cuando en el Siglo XX se soñaba, imaginaba, que se ligaba con el/la vecin@ del 5º, Sofía Loren o Alain Delon. Se podía reconocer o no. Probablemente en determinados círculos de Yoes Biológicos de similar edad y mismo género se reconocía, y ante otro Yo Biológico de similar edad y distinto genero no. El problema estaba cuando se traspasaba el plano onírico por el carnal. Así debe suceder, de forma analoga, en el Siglo XXI con el Yo Digital.
Sin embargo en el Siglo XXI el Yo Digital es mucho más complejo puesto que las iteraciones digitales, al contrario que las mentales, tienen un interlocutor digital que lleva asociado un Yo Biológico, y esto complica el problema puesto que:
- Las interacciones digitales ya no son exclusivamente mías, sino también del otro Yo Digital.
- Las interacciones digitales pueden inducir comportamientos analógicos en ambos extremos.
Siguiendo esta 2ª ley, Solo se puede responsabilizar a un Yo Digital de las acciones inducidas por la parte compartida entre dos Yo Digitales, puesto que ir más allá iría en contra de la primera ley. La inviolabilidad del Yo Digital.
¿Quieres decir que no somos responsables de lo que hacemos/pensamos en nuestra intimidad pero sí de lo que compartimos en las interacciones con los demás?, ¿qué tiene que haber un espacio privado exento de responsabilidad?.
Si un empleado en su yo digital está de alguna manera robando y le descubren, es un ámbito privado pero punible.
Si con otro yo digital jugamos a asesinatos, es un ámbito social no punible.
Creo que la clave es la delimitación de un espacio de ficción, en el cual no hay responsabilidad ni consecuencias adaptativas, tanto para el yo biológico como para el digital.
Vaya, es otra aproximación. Aunque no me gusta pues va orientada a la culpabilidad o punibilidad. Si existe la palabra.
Personalmente yo, que soy muy responsable y poco serio, me responsabilizo de todo aquello de lo que soy consciente. El otro día conté un chiste de jamones de jabugos ante un judío ortodoxo. Fui mal educado, a saber, pero no me considere culpable al ser inconciente.
En el ejemplo que pones, si un empleado roba con su ordenador, como lo hace a alguien, ya está interactuando, luego a más de ser responsable es, si existe alguna ley que lo prohíba, creo que si, culpable. Puesto que ha interactuado.
Eso si, su yo digital, proyectado en el ordenador debería de ser inviolable. Imagina el montón de cosas que tenemos en nuestro yoes (digitales y biológicos), que no son acordes con los usos y costumbres. Y que no hemos compartido. De esas sólo somos responsables con nosotros mismos, y yo suelo ser muy indulgente conmigo mismo.
En cuanto al ámbito de ficción, podría estar más de acuerdo, aunque no es fácil de discernir. Para mi es más real spiderman, que la constelación de Orión. (por cierto esta podía haber desaparecido hace siglos y aun no nos habríamos dado cuenta, perdón, aun algunos no se habrían dado cuenta)

Otra cosa, ¿no son interacciones en lugar de iteraciones?
Ok, you are right, cambio iteración por interacción. A ver si así se entiende.
Rectificar es de sabios e incluso fácil con un blog.
Álvaro, yo interpreto esta ley en el sentido de que el todo no debe pagar por la parte.
Siguiendo el ejemplo dado por Irene, si yo cometo un robo de datos en un entorno digital, tanto mi yo analógico como mi yo digital serán en efecto responsables de dicha acción… Pero eso no será condición suficiente para que el ministerio fiscal, la prensa, etc puedan hacer público el resto de información que configura mi vida digital, y que no guarda relación alguna con el delito del robo de datos.
No obstante, aunque inviolable, nuestra vida digital no puede estar desconectada de su homóloga analógica, y por tanto debe haber un vínculo de responsabilidad que una ambas.
Sigo el debate interesante que estáis construyendo. Creo que deberíamos tirar de la LEY de PROTECCIÓN de Datos… ¡Chicos/as¡ Tengo un esquema para un proyecto de formación en un curso de protección de datos… Ahora no tengo tiempo de desarrollarlo, pero para dentro de mes y medio o dos meses es posible que sí. Ya vendría entonces una entrada sobre esta Ley.. ¡Ánimo!
O sea, según esto, si se pilla a un terrorista con su ordenador personal, al considerar lo en él grabado parte de su intimidad inviolable no se debería ni intentar leer. ¿?
Estoy de acuerdo pero por el bien comun debería haber un limite. Las tres leyes de la robotica se reescribieron luego con la ley número cero:
‘Un robot no puede hacer daño a la humanidad o, por inacción, permitir que la humanidad sufra daño.’
Donde se extiende la individualidad por la humanidad y se lia todo.
CorsarioVallekano, precisamente por eso decía yo en mi comentario: “no será condición suficiente para que se pueda hacer público el resto de información que configura mi vida digital, y que no guarda relación alguna con el delito del robo de datos”
Es decir, mi yo digital debería ser privado e inviolable… Lo que no significa blindado. Para eso están las órdenes judiciales de registro, ¿no? Es decir, las instancias pertinentes sí podrían acceder al ordenador personal (o a la vida digital) del terrorista de tu ejemplo, pero siempre y cuando hubiera indicios en su contra para justificar la incursión. No obstante, siguiendo con el ejemplo, eso no daría libertad a nadie para desvelar la identidad del sospechoso en un foro sobre música electrónica en el que éste participaba asiduamente bajo el nick de “technocaperucita roja”, por ejemplo.
Creo que hay que conservar en esta segunda ley su naturaleza social. ¿Qué os parece:
1ª Ley sobre el derecho a mantener la intimidad en el entorno digital
2ª Ley sobre el deber de no hacer daño a otros yoes digitales
3ª Ley sobre el deber de no hacerse daño a sí mismo
Sobre la segunda ley:
Si el yo digital que hemos diseñado tiene emociones, también será posible hablar de atenuantes: el yo digital también será celoso, envidioso….
¿Nos atreveríamos a decir que el Yo Digital TIENE emociones? o ¿lo vemos como un registro y especificación de aspectos emocionales de la biografía del usuario?……
Creo que la técnica no va tan lejos como para que nuestro Yo Digital tenga emociones independientes a las nuestras. De ahí al libre albedrío de nuestro Yo Digital y exonerarnos de sus conductas hay un sólo paso.
Estoy más con Hall 9000, en tanto en cuanto es más un registro de nuestras emociones. Aunque estás sucedan en entornos digitales que no tengan nada que ver con la realidad analógica.
Igual en mi universo digital tengo varios sexos y actuó por otras motivaciones que no experimento en la vida biológica. Pero en cualquier caso sigo siendo yo en mi proyección digital.
Independientes no, pero sí potenciadas. En el proyecto del yo digital no sólo hay registro sino etiquetado consciente de la emoción que produce una información o un contacto. Al poder contar con mapas emocionales el usuario podrá darse cuenta de un montón de variables que determinan su conducta subliminarmente. Se espera que el yo digital “despierte” el mundo emocional lo cual puede ser beneficioso si se controla o tremendamente pernicioso si se desmanda. Esto tiene que ver con la tercera ley del yo digital.
Pues a mi me parece obvio que el yo digital debe tener las mismas responsabilidades que los reales, aunque quiza mas “atenuadas”. Despues de todo, si no saben quien eres, no pueden culparte.
